Welcome to iggi patterns. These Terms of Service (Terms) govern your access to and use of our website, services, and digital products (collectively, the Services). The Services are provided by iggi patterns (we, us, or our).

By visiting our store, accessing our website, or purchasing digital products from us, you agree to be bound by these Terms. Please read them carefully.

Scope of Products and Exclusive Digital Delivery
No Physical Products or Finished Garments: All items sold through this store are strictly digital products provided in electronic format (such as downloadable PDF sewing patterns, digital instructions, and electronic guides). We do not manufacture, sell, ship, or deliver any physical goods, physical paper patterns, fabrics, or physical garments.
Technical Requirements: You are solely responsible for ensuring that you possess the necessary hardware, software, PDF readers, and printers required to open, view, and print the digital download files provided.

Strict License Terms and Non-Commercial Restrictions
Personal and Non-Commercial License Only: Upon purchasing a digital product, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, view, and print the digital file solely for your individual, private, personal use.
Absolute Prohibition of Commercial Use: You are explicitly prohibited from using our digital patterns, designs, or instructions to produce physical garments, clothing, or items for sale, commercial distribution, mass production, tailored commissions, or retail trading.
Prohibition of Resale, Sharing, and Distribution: You are strictly prohibited from reselling, forwarding, sharing, renting, licensing, copying, transferring, or uploading our digital files, patterns, or instruction guides to file-sharing websites, social media channels, forums, or cloud storage systems, whether for free or for commercial gain.
Intellectual Property and Image Protection: All photographs, text, pattern pieces, brand graphics, and instructions on this website are protected under international copyright laws. You may not use, download, copy, edit, or reproduce our photography, product listings, or branding for any personal or commercial promotion.

Contractual Penalty and Claims for Copyright Infringement
Enforcement of Copyright: Any unauthorized distribution of our digital files, commercial sale of garments produced using our patterns, or unauthorized use of our copyrighted images constitutes a severe breach of these Terms and a direct violation of applicable copyright laws.
Contractual Penalty and Damages: In the event of a breach of Section 2 of these Terms (including unauthorized sharing, commercial production of garments, or piracy), we reserve the right to enforce statutory damages, license-analogous compensation, and legal costs against the violator. Furthermore, any willful or grossly negligent infringement shall trigger a contractual penalty per breaching act, calculated based on the full statutory measure under German Copyright Law (Urheberrechtsgesetz - UrhG), in addition to our right to seek immediate injunctive relief and criminal prosecution.

Pricing, Payments, and Immediate Execution
Payment Terms: All prices are displayed on our store and are subject to change without notice. Payments must be completed in full at the time of purchase using our accepted payment gateways.
Immediate Delivery and Loss of Right of Withdrawal: Due to the digital nature of instant download files, all sales are final. By completing your purchase and consenting to the immediate execution of the contract and the delivery of digital access, you explicitly agree to waive and forfeit your statutory 14-day right of withdrawal or cancellation under European Union and international consumer protection laws. No refunds or exchanges will be provided once access or download has been initiated.

Disclaimer of Warranties and Limitation of Liability
As Is Basis: All digital patterns, instructions, and files are provided on an as is and as available basis without warranties of any kind, whether express or implied.
Sizing and Skill Disclaimer: Garment construction, fitting, and sizing vary based on individual technique, fabric choices, and sewing skills. We do not guarantee specific personal fit or sewing results.
Maximum Limitation of Liability: To the maximum extent permitted by applicable law, iggi patterns shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use our digital files. In all cases, our total liability to you shall not exceed the exact monetary amount paid by you for the specific digital file in question.

Governing Law and Exclusive Place of Jurisdiction
Governing Law: These Terms and all disputes arising from purchases or use of our Services shall be governed exclusively by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
Jurisdiction: To the extent permitted by law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms shall be Munich, Germany (Gerichtsstand München).
